Terms & Conditions

Welcome to Empire Designs & Marketing! By engaging our services, you agree to the following terms and conditions, which ensure a clear, professional, and mutually beneficial working relationship. Please review these terms carefully.

1. Services Provided
We specialize in branding, website design, graphic design, and marketing services. Each service is tailored to meet your specific needs. A detailed project agreement will outline the exact scope of work, deliverables, and timelines before commencing any project.

2. Project Scope
The scope of work will be clearly defined in your proposal or agreement.

  • Client Responsibilities: Clients must provide all necessary information, materials, and feedback in a timely manner to ensure smooth project execution.

  • Scope Changes: Any requests beyond the agreed scope will be treated as additional work and charged accordingly. A new timeline and cost will be discussed for any such changes.


3. Payment Terms

  • Payment Requirement: Full payment is required before work begins unless otherwise agreed upon. This guarantees your commitment and allows us to allocate the necessary resources for your project.

  • Alternative Payment Plans: If discussed, a payment schedule may involve a deposit before project commencement, with the balance due upon delivery or specific milestones. This will be outlined in writing.

  • Accepted Payment Methods: Payments can be made through EFT. Details for payment will be provided with your invoice.

  • Invoices: Invoices will be sent for all payments, and clients are expected to settle them within the stated due date.

  • Non-Refundable Deposit: Any initial deposit paid is non-refundable as it covers project initiation, planning, and resource allocation.

  • Final Payment Release: Final deliverables, including files and access, will only be handed over once the total payment has been received.

  • Overdue Payments: Payments not made within the agreed upon time may incur a late fee of 10% of the total project cost. Failure to pay after multiple reminders could result in project suspension or legal action.

4. Revisions Policy

  • Projects include limited rounds of revisions as part of the agreement.

  • Additional revisions or changes beyond the scope will be charged at an hourly rate of R600.

  • Revision requests must be submitted within the timeline specified in the agreement.


5. Delivery Timeline

  • We aim to deliver high-quality results within the agreed timeframe.

  • Timely feedback from clients is crucial to avoid delays.

  • If a client delays providing feedback or approvals, the delivery date may be adjusted.


6. Intellectual Property Rights

  • Ownership of final deliverables will transfer to the client upon full payment.

  • Empire Designs & Marketing retains the right to showcase completed work in our portfolio, unless a prior written agreement specifies otherwise.


7. Confidentiality

  • We value your privacy and will keep all shared information confidential.

  • Any use of your project for marketing purposes (e.g., as a case study) will require your approval.

  • Proprietary client information will not be shared or disclosed.


8. Termination of Agreement

  • Either party may terminate the agreement with written notice.

  • If terminated, the client is responsible for paying for work completed up to the termination point.

  • Deliverables for completed work will be provided upon payment.


9. Liability
Empire Designs & Marketing is not responsible for any losses incurred from the use of deliverables.

This includes, but is not limited to, data loss, business revenue loss, or errors caused by misuse of the materials provided.


10. Governing Law
These terms and conditions are governed by the laws of South Africa. Any disputes arising from these terms will be resolved in accordance with these laws.

11. Amendments
We reserve the right to update these Terms & Conditions as necessary. Clients will be informed of significant changes.
